Terms of Service

1. Agreement

By accessing or using Riskjar ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of service

Riskjar is a web-based risk management platform that enables teams to identify, assess, and manage risks across projects. The Service includes features such as risk scoring, action tracking, team collaboration, notifications, and reporting.

3. Account registration

• You must provide a valid email address to create an account.
• You are responsible for all activity under your account.
• You must be at least 16 years old to use the Service.
• One person or legal entity may not maintain more than one free account.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorised access to the Service or its infrastructure.
• Interfere with or disrupt the Service or servers.
• Upload malicious code or content.
• Use the Service to send spam or unsolicited communications.
• Resell, sublicense, or redistribute the Service without written permission.

5. Your data

• You retain ownership of all data you upload or create in the Service ("Your Data").
• We do not claim any intellectual property rights over Your Data.
• You grant us a limited licence to process Your Data solely to provide and improve the Service.
• You can export Your Data at any time using the export features provided.
• We handle Your Data in accordance with our Privacy Policy.

6. Free and paid plans

• The free plan includes limited features as described on our pricing page.
• Paid plans are billed in advance on a monthly or annual basis.
• Prices are in USD and exclude applicable taxes.
• You may upgrade, downgrade, or cancel your plan at any time.
• Downgrading may result in loss of access to certain features, but we will not delete Your Data.

7. Payments and refunds

• Payments are processed securely by Stripe. We do not store your credit card details.
• If you cancel, your subscription remains active until the end of the current billing period.
• We do not provide refunds for partial months or unused time, except as required by law.

8. Service availability

• We strive to maintain high availability but do not guarantee uninterrupted service.
• We may perform scheduled maintenance with reasonable advance notice.
• We are not liable for downtime caused by circumstances beyond our control.

9. Intellectual property

The Service, its design, code, and branding are the property of Riskjar and are protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

10. Limitation of liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind.
• We are not liable for indirect, incidental, special, or consequential damages.
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
• Riskjar is a tool to assist with risk management. It does not replace professional risk assessment or legal advice. You are solely responsible for your risk management decisions.

11. Termination

• You may delete your account at any time.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, we will delete Your Data within 30 days, unless retention is required by law.

12. Changes to terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

13. Governing law

These Terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of Switzerland, without prejudice to any mandatory consumer protection provisions that may apply in your country of residence.
